Webpage Authoring
Goodchilds Media Limited offer webpage authoring on a quote basis. Goodchilds Media Limited will inform you in writing with a pricing estimate to reach your requirements prior to undertaking any work. An alteration during and after work has been undertaken could increase charges and you will be informed of an hourly rate in this case. All HTML, JPG, GIF and MDB content remains the customers property and a copy can be requested on CD-ROM for a nominal fee.
Custom Scripting
All scripts written by Goodchilds Media Limited for a customer remain property of Goodchilds Media Limited at all times and are loaned free of charge to customers while Goodchilds Media Limited maintains control of the website. This includes all pages written in Active Server Pages (ASP). Release of Goodchilds Media Limited for use by another provider will require a release fee. All scripts written by Goodchilds Media Limited are bespoke systems and are designed to work on Windows NT/2000 servers only. A release of scripts may entail scripting fees to enable scripts to work on any server. After a script has been released no ownership tags must be removed in the coding.
Control Panels
Goodchilds Media Limited takes no responsibility for actions taken by yourself which may cause shopping cart scripts to function incorrectly. Goodchilds Media Limited will not be held responsible for any costs incurred as a result of your actions.
Server Use
Business accounts are to be used by the primary owner only. Business account holders are not permitted resell, store or give away web-hosting services of their website to other parties. Web hosting services are defined as allowing a separate, third party to host content on the owner's web site. Exceptions to this include ad banners, classified ads, and personal ads.
Goodchilds Media Limited reserves the right to refuse service and /or access to its servers to anyone.
Goodchilds Media Limited do not allow any of the following content to be stored on its servers:
Illegal Material - This includes copyrighted works, commercial audio, video, or music files, and any material in violation of any Federal, State or Local regulation.
Adult Material - Includes all pornography, erotic images, or otherwise lewd or obscene content. The designation of "adult material" is left entirely to the discretion of Goodchilds Media Limited.
Warez - Includes pirated software, ROMS, emulators, phreaking, hacking, password cracking. IP spoofing, etc., and encrypting of any of the above. Also includes any sites which provide "links to" or "how to" information about such material.
Unlimited Use Policy
High bandwidth usage: Goodchilds Media Limited offers very large ratios of bandwidth per customer. In rare cases, Goodchilds Media Limited may find a customer to be using server resources to such an extent that he or she may jeopardize server performance and resources for other customers. Goodchilds Media Limited therefore imposes a limit of 2Giga Bytes of transfer within the period of 30 days. In such instances, Goodchilds Media Limited reserves the right to impose the High Resource User Policy for the consideration of all customers.
Payment Policies
All accounts are set up on a prepay annual basis. Exceptions to this may include monthly management fees. Although Goodchilds Media Limited reserves the right to change prices of accounts or services at any time all pricing is guaranteed for the period of prepayment. Payment is due each anniversary year following the date the account was established. Customers will automatically be invoiced again 30 days prior to the end of their prepay period unless closure notification has already been given. Failure to clear any outstanding balance within 40 days of the invoice date, will result in a temporary suspension of services and a penalty of £65.00 will be incurred. A non-refundable deposit of 25% of a project value is required before Goodchilds Media Limited undergoes work for any website/script. Goodchilds Media Limited reserves the right to suspend other services until the outstanding debt is cleared. The customer is responsible for all money owed on the account from the time it was established to the time that the customer sends a written cancellation request. All payment is in UK sterling.
Cancellation & Refunds
Goodchilds Media Limited reserves the right to cancel the service at any time. Customers may cancel their account at any time. A transfer and administration fee of £65 + VAT will be charged when transferring any Hosting package. If a customer contravenes Goodchilds Media Limited's terms of service additional costs may be accrued. Initial set-up fees are non-refundable. (Eg: SSL, Statistics & Control Panels)
Indemnification
Customer agrees that it shall defend, indemnify, save and hold Goodchilds Media Limited harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney's fees asserted against Goodchilds Media Limited, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, its agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless Goodchilds Media Limited against liabilities arising out of; (1) any injury to person or property caused by any products sold or otherwise distributed in connection with Goodchilds Media Limited server; (2) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party; (3) copyright infringement and (4) any defective products sold to customer from Goodchilds Media Limited server.
Hosting Disclaimer
Goodchilds Media Limited will not be responsible for any damages your business may suffer. Goodchilds Media Limited makes no warranties of any kind, expressed or implied for services we provide. Goodchilds Media Limited disclaims any warranty or merchantability or fitness for a particular purpose. The includes loss of data resulting from delays, nondeliveries, wrong delivery, and any and all service interruptions caused by Goodchilds Media Limited and its employees. Goodchilds Media Limited reserves the right to revise its policies at any time.
